Terms of Service for Forexobroker.com

These Terms of Service (“Terms”) govern your access to and use of forexobroker.com, including all subdomains, content, indicators, expert advisors, downloadable files, tutorials, articles and email communications (together, “the Site” and “the Service”). By using the Site you agree to be bound by these Terms in full. If you do not agree, you must stop using the Site.
1. Definitions
In these Terms, “we”, “us” and “our” refer to Dominic Walsh, the operator of the Site, based in the United Kingdom. “You” refers to any individual who accesses the Site, subscribes to the newsletter, downloads any free tool or otherwise interacts with the Service. “Content” means any text, image, video, indicator file, expert advisor or downloadable resource published on or distributed through the Site.
2. Eligibility
You confirm that you are at least 18 years old and that you are legally permitted to view and interact with educational material about leveraged foreign exchange trading in your country of residence. The Site is not intended for children and is not directed at any individual under 16 years of age.
3. Licence to use the Content
Subject to your continued compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to access and read the Content on the Site, to download any free indicator or expert advisor we make available, and to use those free tools on your own MetaTrader installation. The licence does not include any right to resell the Content, to redistribute downloaded files, to incorporate them into another commercial product, or to claim authorship of any tool, article or methodology originating on the Site.
4. Acceptable use
You agree to use the Site only for lawful purposes. In particular, you must not:
- Scrape, copy or republish substantial portions of the Content without our prior written permission.
- Attempt to reverse-engineer, decompile or modify any indicator, expert advisor or piece of software distributed via the Site, except to the extent permitted by applicable law.
- Use the Site, the newsletter or any embedded form to send unsolicited messages, distribute malware, or carry out any form of automated abuse.
- Use the comments section to post material that is unlawful, defamatory, harassing, discriminatory, sexually explicit, or that infringes the intellectual-property rights of any third party.
- Submit personal data of any third party through a Site form without that person’s consent.
- Attempt to bypass any security or access-control measure on the Site, including but not limited to brute-force login attempts and exploitation of disclosed vulnerabilities.
5. User-submitted content
When you post a comment under an article or submit text through any form on the Site, you grant us a worldwide, royalty-free, non-exclusive licence to display, store, moderate and excerpt that content in connection with the Site’s operation. We reserve the right to refuse, edit, move or delete any user-submitted content for any reason, including breaches of the acceptable-use rules in Section 4. We do not, however, accept any obligation to monitor or pre-moderate user submissions.
6. Intellectual property
Unless otherwise stated, all Content on the Site is the intellectual property of Dominic Walsh or his licensors and is protected by copyright, database right and other applicable laws. The name “Forexobroker” and the Site logo are unregistered trademarks of the Site owner. You may share short quotes from articles for non-commercial purposes, provided you cite the source and link back to the original page. Any other reproduction, distribution or commercial use requires our prior written consent.
7. Third-party content and links
The Site contains links to and embeds from third-party websites, including regulator pages, broker sites, MQL5 documentation, educational platforms and video providers. Those third parties have their own terms and privacy policies, and we are not responsible for their content, accuracy or commercial conduct. Following a link or interacting with an embedded video may transmit some personal data (such as your IP address) to the third party in question; please review their own policies before doing so.
8. Affiliate and partner disclosure
Some links on the Site are affiliate links. If you follow such a link and subsequently sign up with a broker, prop firm, software vendor or platform, we may earn a referral commission at no additional cost to you. Affiliate relationships do not influence the methodology, opinion or recommendation expressed in any article. Where a piece of content is paid, sponsored or commissioned by a third party, that fact is disclosed prominently at the top of the article itself, consistent with applicable advertising regulation.
9. Disclaimer of warranties
The Site and all Content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we exclude all representations, warranties and conditions, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, or that the Site will be uninterrupted, error-free, secure or free of viruses. 10. Limitation of liability
To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to loss of profits, trading losses, loss of business, loss of data or loss of goodwill, arising out of or in connection with your use of the Site or reliance on the Content. This limitation applies regardless of the legal theory of the claim. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under English law, including liability for death or personal injury caused by negligence or for fraudulent misrepresentation.
11. Indemnification
You agree to indemnify and hold harmless Dominic Walsh and forexobroker.com from any claim, demand, loss or expense (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law or third-party right, or your misuse of the Site.
12. Termination
We may suspend or terminate your access to the Site at any time, without notice, if we reasonably believe that you have breached these Terms or that your continued use poses a risk to the Site, other users or our legal interests. You can stop using the Site at any time. Provisions of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, indemnification and governing law — will continue to apply.
13. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms or your use of the Site is subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer-protection rules of your country of residence apply.
14. Force majeure
We shall not be liable for any delay or failure to perform any obligation under these Terms where the delay or failure results from causes beyond our reasonable control, including but not limited to internet outages, hosting failures, regulator action, acts of God, civil unrest, labour disputes or third-party service failures.
15. Severability, assignment and entire agreement
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. We may assign these Terms in connection with a sale or restructuring of the Site; you may not assign your rights or obligations without our prior written consent. These Terms, together with the Privacy Policy and the Disclaimer, constitute the entire agreement between you and us regarding the Site and supersede any earlier agreements on the same subject matter.
16. Changes
We may update these Terms from time to time. The current version always carries an effective date at the top. If we make material changes that affect your rights or obligations, we will flag those changes prominently at the top of the page. Continued use of the Site after a revised version has been posted constitutes acceptance of the updated Terms.
